New Zealand’s Privacy Act 2020 states that the use or disclosure of personal information—including identifiable images like facial photos—requires the subject’s knowledge and consent, especially when used outside of the original context or for a different purpose.

Even if an image is uploaded to a publicly accessible website (such as an escort platform), that does not mean the person has waived all rights to privacy or allowed the photo to be reused elsewhere.

Reposting the image on a review site, without permission, could violate both Principle 11 (Limits on Disclosure) of the Privacy Act and potentially the subject’s copyright or moral rights, especially if the image is self-created or provided by them.

My request to remove the image is not a threat or an attempt to suppress speech—it is a good-faith effort to protect my privacy and image rights, as allowed under New Zealand law.

Also, my request for you to post just the link (URL) instead of directly reposting the photo of the girl working with me is not a threat either—it’s a polite request. Please consider how the girl would feel if she found her face shared without permission. It could affect her emotionally and potentially lower the quality of her service.

These girls also have futures to think about, and I ask you to respect that.

I hope we can resolve this respectfully and without further escalation.

You've got to stop coming on here and posting things with such an aggressive and hostile tone. It is losing you customers and is bad for the business you are trying to run. Especially when you say things like how you tell other Japanese working girls not to come to New Zealand because we are all such bad customers.

No court or lawyer in New Zealand is going to waste any time over someone posting an image on an internet forum. How many millions of times a day does this happen all over the internet?

Why do you even care if your photo is posted on here anyway if it doesn't show your face... which you show on your ad anyway. Isn't it good for marketing your services? You should know once you post a photo to the internet it is always going to be on the internet. This is why most kiwi girls don't put up face showing photos, especially on escort websites.

It is good you receive a cut from Moe's bookings and will get a cut from the new girl too. That way you will keep making money after losing customers due to your negative attitude.

I didn’t intend to come across as aggressive or hostile. I thought I was responding politely, but I’m sorry if my words made you feel uncomfortable.

All I really want is for the customers to feel happy with the service the girls provide, and for the Japanese girls to be able to work happily and without stress.


When customers repeatedly treat them poorly, it’s only n atural that the quality of service declines. That’s why I write things in detail — to prevent that from happening.

Also, I’m not doing this to make money. I hardly take any money from them — most of it goes to the girls as their salary. I don’t mind losing my customers, as long as the girls are happy.

I fully acknowledge that you have the right to free speech, and I have no intention of taking that away from anyone.

My point was simply to raise a question: Even if a photo is publicly available on an escort ad, is it not potentially a legal issue to use it elsewhere without the person’s permission?

And beyond the legal aspect — isn’t it also a matter of basic manners and respect?
 
We're going too far from what was supposed to be a great review from OnlyHermes. I don't think Sakura has anything to do here nobody posts any photos of your girls here. If Nanami has any problem with this she can create an account and ask people to take down the photos I 100% believe they will do. However looking from the watermarks I'm also 99% sure those photos were taken for promotion purpose, with heavy photo editing and lighting etc. they were meant to be spread. As long as you don't take and post photos of you and your girls revealing the faces you should be fine, so calm down and let this topic be about the OP and his wonderful experience.

There are possible criminal charges if the image is used as part of a criminal offense, e.g harassment or blackmail.

A forum member re uploading the image here for a review at best creates a doomed private law action as the plaintiff would have difficulty with establishing a reasonable expectation of privacy over an image which they voluntarily posted/uploaded online.

Ethical questions are a separate issue, I am responding to your legal comments.

Also, I think there has been some misunderstanding — I never meant to say that there are a lot of bad customers in New Zealand.

However, I have personally felt that there are quite a few rude customers — though of course, it’s only a small portion.

But I’ve come to realize that what I perceive as rudeness often comes from a lack of understanding or knowledge.

That’s why I explain things in detail on the profile.

And I have never told Japanese girls not to come to New Zealand. I simply share openly what it’s really like — how much they can realistically earn, what kind of rude customers they might encounter, and so on.

What I disagree with is the way some other agents operate — they lie and say girls can earn $3000–$4000 everyday, bring them over from Japan, and then just use them to make money for themselves.

I apologize if my words came across as aggressive or hostile due to translation issues.

Those who have met me in person would know that I’m not a harsh person at all.

I also try to be polite in how I communicate here.

Agree also - posting social media photos is a different can of worms. Sakura, on my understanding, is talking about a forum member uploading a photo from a escort advertisement website. Very difficult to win a private law privacy suit in this case (provided the subject consented to the image/advertisement).
 
Damn made me go to 108 kiwi (for researching purpose only), the agency took a whole photoshoot of Koharu with her face not covered. I guess they want to use that as an advantage to win customers. They also talk about how Koharu was reviewed positively on a "foreign" website (which is us), the agency owner said he will have a look lol. They're challenging him on the price being too high (kinda agree with that).
