This notice serves as a formal warning that a legal investigation is currently underway.
All profiles found to be in breach of privacy, defamation, or harassment laws have been documented and included in an active legal case.

Independent sex workers across New Zealand have united in this collective legal action to defend their rights, privacy, careers and safety.

Legal proceedings are progressing, and justice will be pursued to the fullest extent of the law.

We sincerely hope you have not compromised your own relationships, career, or future by participating in this unlawful and damaging behaviour.

Under New Zealand law, sex workers, including those working independently, are protected under the:
Prostitution Reform Act 2003
Privacy Act 2020
Defamation Act 1992
Harassment Act 1997

By publicly posting reviews, identifying details, or descriptive accounts of your experiences, especially if these can reasonably lead to a worker being identified, you are:

Breaching their privacy under the Privacy Act.

Defaming an individual if the information is false, exaggerated, or harmful.

Harassing an individual, if conduct is repeated or malicious in nature.

You are not legally entitled to publicly review or discuss independent contractors in any setting that is identifiable, defamatory, or sexual in nature. These reviews not only cause personal harm but also trigger legal action against you, including:

Complaints to the Office of the Privacy Commissioner
Civil defamation claims
Court orders for harassment or breach of confidence without the option of name suppression.

While we understand you may wish to share experiences, this is not a lawful nor appropriate forum for that when it involves protected workers in the adult industry.

We strongly recommend refraining from further posting, and respect the privacy and dignity of the individuals who provide services lawfully and independently.

Short answer:

This has elements of truth (some of the legal references are real), but the overall tone and absolute claims are mostly bullshit—in the sense that it’s an exaggerated, scare-tactic message likely meant to intimidate.



I’ll break it down clearly:






✅ What is partly true:



  • Prostitution Reform Act 2003: This legalized sex work in NZ and gives sex workers various rights and protections.
  • Privacy Act 2020: You cannot misuse personal information or breach privacy (e.g., doxxing).
  • Defamation Act 1992: Anyone can sue for defamation if false statements harm their reputation.
  • Harassment Act 1997: Repeated or threatening behavior can be harassment.




So, yes—posting identifying information, malicious lies, or threats could in principle breach these laws.






❌ What is exaggerated or misleading:



  • “You are not legally entitled to publicly review or discuss independent contractors…”
    • That is not correct.
    • People are generally entitled to share truthful opinions or factual accounts as long as they don’t breach privacy, defame, or harass.
    • Reviewing services—even sexual services—is not automatically unlawful if done without identifying details or malicious falsehoods.
  • “All profiles… have been documented and included in an active legal case.”
    • This is a boilerplate scare line you often see in these warnings. In real legal proceedings, you would be served with a formal legal notice, not an anonymous forum post.
  • “Court orders… without the option of name suppression.”
    • In reality, most court processes in NZ have at least the possibility of suppression applications, especially in sensitive contexts.
  • “Legal proceedings are progressing…”
    • If that were true, you or your platform would typically have been formally notified already.
  • Tone of the whole message:
    • It reads like a blanket threat meant to shut down discussion, not a real legal notice.







✅ Bottom line:



  • If you posted personal identifying information, made false claims, or repeatedly harassed a worker, you could be exposed to complaints or civil claims.
  • But posting fair, non-identifying, or honest reviews is not in itself illegal.
  • The sweeping claims here (“you are not entitled to publicly review”) are mostly nonsense.
  • If there were real legal proceedings, you would get an actual letter from a lawyer, not this kind of forum post.







Verdict:

This is 80% intimidation bluff and 20% legitimate reminder to avoid doxxing or defamation.
 
In the past I have found SexForum has done a good job of removing posts which contain identifying information such as the private addresses independent escorts work out of. I haven't really seen any posts doxing an escorts real name... apart from Inaaya (a link to her possibly real Instagram) but she seems to be somewhat public about her profession.

As our friend @bigdicktrump has stated lawyers and others often send out empty threats like this when they have little to no actual legal standing to try intimidate people into complying with their demands.

Will be interesting! the Privacy Commissioner only investigates agencies breaches in privacy… Government departments. That any defamation and privacy claim would have to proceeded in a district court as an individual civil proceeding would cost the plaintiffs a minimum of $35-50k and a large class proceedings would cost in the realms of hundreds of thousands. Retraining orders would have to be under the digital harm act there is qualifying criteria and require netsafe as the only approved agency to investigate them to generate a report. And don’t start me on the whole security for costs aspects,

More of the SW should be under scrutiny if anything considering how many would have oral sex without a condom/dental dam. If thats the case?
