You are conflating two concepts. Illegality against the PRA and health risks. They aren't mutually dependent. On the legality side, technically it could be argued for example that fingering a SW without having a condom on that finger is illegal. Who does that?
On the health side it's up to the individual to assess their risk tolerance from a health perspective and act accordingly.
